The specific conditions of each property are described in detail on its listing. By accepting these conditions, The User also accepts the specific conditions of the property they are about to book.
This service is provided by Marc Munar Gaspar, a self-employed professional operating under the trade name Habitur, with tax ID (NIF) 41540085S and address at Llorenç Frau, 84, 07198 Palma (Balearic Islands). Hereinafter, HABITUR.

HABITUR is the intermediary agent between The Property and The User in rental transactions.
The Property refers to the owner or legal representative of the home who has engaged HABITUR as intermediary to carry out rental transactions. Hereinafter, The Property.
The User refers to the customer interested in renting The Property's home. Hereinafter, The User.
These booking conditions govern the contractual relationship between The Property and The User.
HABITUR is not a contracting party, either as landlord or as tenant, in the rental of the home. HABITUR acts in the name and on behalf of The Property and The User in the seasonal rental for purposes other than permanent residence, subject to Spanish Law 29/1994 of 24 November on Urban Leases, in particular Article 3.2, or as a Holiday Tourist Stay (Estancia Turística Vacacional, ETV) subject to Law 8/2012 of 19 July on Tourism in the Balearic Islands and its implementing regulations, for homes licensed for that purpose.
Accepted payment methods are bank transfer and credit or debit card (Visa and MasterCard).
When making the booking, The User must pay an amount as a deposit. This amount will be specified at the time of booking and may vary depending on the arrival and departure dates and the number of guests selected.
If bank transfer is the chosen payment method, The User will have 48 hours to pay the deposit. If it is not paid within that period, HABITUR reserves the right not to proceed with the booking.
Once the deposit payment has been received, HABITUR will send The User the booking confirmation.
If the deposit is less than 100% of the booking total, the remaining amount must be paid within the periods indicated at the time of booking, which may vary depending on the dates and number of guests selected. If payment is not made within that period, HABITUR may cancel the booking and the cancellation policy described in section 6 of these conditions will apply.
When payment is made by bank transfer, The User must send HABITUR a copy of the proof of payment by email. Any bank charges and fees for these transactions will be borne exclusively by The User.
Prices are expressed in euros (€) and, as a general rule, include the applicable taxes unless otherwise stated. At the time of booking, it will be indicated whether the Balearic Islands sustainable tourism tax is included in the price or must be paid separately.
The Property, or HABITUR on its behalf, reserves the right to request a security deposit to cover damage, breakages, defects, theft or excessive dirt in the home. If requested, this information will appear in the security deposit section of the property listing.
The security deposit will be paid by bank transfer or credit or debit card (Visa or MasterCard) and must be paid no later than the day of arrival. The User will receive a payment reminder by email 7 days before the arrival date.
The security deposit will be refunded within 7 days after departure, provided no damage has been caused to the accommodation.
In exceptional cases, payment of the security deposit in cash will be accepted. In that case, The User must provide an account number to which the deposit will be refunded within a maximum of 7 days after departure.
If no security deposit has been paid, The Property, or HABITUR on its behalf, may claim from The User an amount equal to the cost of any damage, theft or excessive dirt as compensation. The User is liable for any damage caused to the home during their stay for reasons attributable to them or their companions.
The booking may be changed by written request to HABITUR, under the following circumstances and conditions:
The stay may be extended provided the home is available on the requested dates. The change will not take effect until the new payment is received, which will be calculated according to the payment conditions defined at the time of booking.
Shortening the stay must be notified as far in advance as possible. The total price will be adjusted according to the payment and cancellation conditions set at the time of booking. Any reduction will always be subject to the minimum stay established for the home on the selected dates.
The number of guests may be changed provided the home has sufficient capacity and reasonable notice is given.
If The User cancels the booking, the conditions indicated at the time of booking will apply, which may vary depending on the dates and number of guests selected.
If The User fails to arrive at the home without prior notice (no show), they will lose 100% of the total booking amount.
HABITUR may refund or waive cancellation penalties if The User has to cancel due to an unexpected circumstance beyond their control. The circumstances covered are set out below. Before requesting a cancellation, The User must check that their case is included and that they can provide the required documentation.
Penalty free cancellations only apply to force majeure events occurring before the arrival date.
No documentation is required in these cases, but HABITUR will review each situation to confirm that The User is directly affected:
The Property or HABITUR may be forced to cancel a booking due to force majeure. If for this reason the home cannot be offered in optimal condition, The User may choose between accepting another home, subject to availability, or cancelling the booking. In the latter case, HABITUR will refund the amount paid up to the date of cancellation.
HABITUR reserves the right to cancel the booking in the event of unforeseen circumstances beyond its control, including but not limited to:
Neither The Property nor HABITUR accepts liability for any theft that may occur in the home during The User's stay, or for personal belongings left behind.
The maximum occupancy of the home is stated in the booking confirmation. Exceeding the permitted capacity without prior authorisation may result in cancellation of the booking without refund.
The home is intended exclusively for seasonal or tourist accommodation. It may not be used for other purposes, such as banquets, celebrations, parties or seminars, without the prior authorisation of The Property or HABITUR.
Carrying out activities other than a seasonal or tourist stay, or exceeding the maximum capacity of the home, will result in the immediate termination of the rental under the terms described above.
HABITUR strives to provide accurate descriptions of all published homes and to guarantee their quality. However, there may be minor differences from the published photographs due to improvements and updates made to the accommodation.
HABITUR undertakes to address any deficiency in the home as soon as possible and to do everything possible to resolve it when necessary.
Pets are not prohibited as a general rule, but The User must request The Property's authorisation through HABITUR before confirming the booking.
The home will be handed over clean and equipped with bed linen and towels. The User is responsible for keeping it clean during their stay.
Where the home includes cleaning, linen change or garden or pool maintenance services, the staff in charge may hold a key and access the home, even in The User's absence.
For stays of more than seven days, The User will receive one change of bed linen and towels at no additional cost.
In compliance with Spanish Royal Decree 933/2021 of 26 October, HABITUR is required to collect and report to the competent authorities certain data on all guests, including their identity document details. The User undertakes to provide this information before or upon arrival.
Personal data provided by The User will be processed in accordance with HABITUR's Privacy Policy.
These conditions are governed by Spanish law. Any dispute that may arise between the parties will be subject to the courts and tribunals that are competent under the applicable regulations. Where The User is a consumer, the courts and tribunals of their place of residence will have jurisdiction.
