The ETV licence in Mallorca is one of the first things that should be checked before marketing a property as holiday accommodation.

However, confirming that a property can legally be used as a holiday rental involves more than simply finding a licence number on a document. It is important to understand how the property is registered, how many guests it is authorised to accommodate, under which category it may be marketed and which specific conditions it must meet.

What is an ETV?

ETV refers to tourist stays in residential properties. In practical terms, it identifies properties that are authorised to carry out holiday rental activity in accordance with the applicable regulations.

Before listing a property on Airbnb, Booking.com, Vrbo or any other channel, one of the first steps should be to check that the property is correctly registered in the Mallorca Tourism Register and that the registered information matches the actual property.

It is not enough to know that the property “has a licence”

The regulations governing holiday rentals in Mallorca establish different conditions depending on the property, its category and the area in which it is located.

It is therefore important to check aspects such as the authorised number of guests, the category under which the property may be marketed, any possible time restrictions and any other conditions that specifically apply to the property.

It is also advisable to make sure that the information used in the listings matches the official documentation. A property should not advertise a higher capacity than it is authorised for or be marketed under conditions that do not correspond to its legal status.

The licence is only one part of the obligations

Legally managing a holiday rental does not end with having an ETV licence.

There are also other administrative and tax obligations during the operation of the property, including the correct management of guest registration, the corresponding notifications to the authorities and the management of the Balearic Islands Sustainable Tourism Tax.

Documentation relating to the property should also be kept up to date, and the applicable obligations regarding tourism, taxation, safety and the operation of the accommodation must be respected.

Regulations can change

Holiday rentals in Mallorca are subject to regional, island-level and, in certain areas, municipal and national regulations.

This means that a situation that was valid several years ago should not automatically be assumed to remain valid today. Before managing a property, it is advisable to review its administrative status again and check the current regulations that apply to the specific case.

  • That the registered information and authorised capacity match the actual property.
  • The category of the property and any specific conditions that may apply.
  • The documentation required to carry out the activity.
  • The obligations relating to guests, tourist tax and holiday rental operations.

The regulations can be complex, but starting from a properly reviewed legal position helps prevent problems later and allows the property to be managed in a much more professional way.
